A London man suffering from an incurable neurological disease has filed a massive lawsuit after health officials allegedly will not provide him with an assisted home care team and instead offered him medically assisted death.

42 year old Roger Foley says that a government selected home care provider had left him with injuries and food poisoning. After that, Foley was sent to London’s Victoria hospital where he has been kept for two years. He is suing the hospital, several health agencies and the attorneys General of Ontario and Canada with the hope to set up and manage a home care team and leave the hospital.

According to Foley's statement, the only two options given to him are a “forced discharge” from the hospital “to work with contracted agencies that have failed him” or medically assisted death.

None of the allegations made in Foley's lawsuit have yet to be tested in court.
